Natureza jurídica das plataformas marítimas

Abstract

The goal of this research is to debate about the legal nature of the maritime platforms and its inclusion on the definition of vessel, issue that has caused polemic in the judicial area, mainly after the case involving the enterprise Petróleo Brasilero –Petrobras S/A. In the first chapter, the definition of vessel is presented, by the law and by the legal doctrine, and in the second, the maritime platforms definition. In the same chapter, many laws that describe these structures as vessel are shown. In addition to this, it is exposed how these platformsare similar to ships. The lastchapter is based on the Petrobras case and its argument against the Brazilian Federal Revenue Office on the court, trying to prove the thesis presented on the previous chapter,showing the points defended by both parts. Finally, it is quoted how the subject can affectthe national economy and the urgent necessity of a clear and definite Legislation about the issue.
